INDIA: Threadbare discussion on efficacy of Senior Citizens Act

Photo: Press Information Bureau, Government of India. _____________________________________________________________ NEW DELHI (The Hindu - PTI), August 28, 2008: Divergent views emerged over the efficacy of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, on Thursday as a number of academicians and personnel from police and legal services debated during the national consultative meet on "Safeguarding Rights of the Elderly of India" here. A panel of speakers including members from UNFPA, police, legal services and academicians made a threadbare discussion of the provisions of the Act during the meeting. Arguing that it remains uncertain as how to many parents would like to see their wards in jails for not attending them, N K Chadda from Delhi University said in a sample survey by DU students in North West Delhi, a majority of people in the survey said the Act would foster suspicion and distrust between two generations. Other speakers sounded sceptical whether the Act's provision, which did not allow any legal practitioner to represent any party in such matters before a tribunal or appellate tribunal, will stand legal scrutiny or not. On the other hand, a large number of delegates argued that with recurrence of large number of incidents of neglect and harassment of the elderly people, some legal measure like this Act is required to protect the rights of the elderly. Justice Ms Gita Mittal, in her inaugural address welcomed the Act's provision for spreading awareness and sensitisation among the young to respect elders, which is enshrined in the Act. The meet was organised by the National Institute of Social Defence under the Ministry of Social Justice and Empowerment in the context of the Act in collaboration with a non government organisation (NGO), Anugraha.
